Terms of Services
These Terms of Service (the “Agreement”) are an agreement between Pastis Enterprises (“Pastis Enterprises,” “us,” or “our”) and you (“User,” “you,” or “your”). This Agreement outlines the terms and conditions for using the products and services provided by Pastis Enterprises, the PastisEnterprises.com website, and the PastisEnterprises.net website (together referred to as the “Services”). By using the Services, you agree to follow this Agreement. If you do not agree to these terms, you cannot use or access the Services. Please note that there are class action and arbitration provisions that may affect your rights.
Additional Policies and Agreements
Use of the Services is also governed by the following policies, which are incorporated by reference into this Agreement and form one in the same. By using the Services, you also agree to the terms of the following policies:

Additional terms may also apply to certain Services, and are incorporated by reference herein as applicable. For example, if you register a domain name with us, then the Domain Registration Agreement will also apply to you and would be incorporated herein.
Account Eligibility
By registering for or utilizing the Services, you affirm and guarantee that you are at least eighteen (18) years of age. The Services are exclusively intended for individuals who are eighteen (18) years of age or older. Any registration, use, or access to the Services by individuals under the age of eighteen (18) is unauthorized and constitutes a violation of this Agreement.
If you are utilizing the Services on behalf of a legal entity or another individual, you confirm that you are authorized to bind that entity or individual to this Agreement and to represent their interests in connection with any actions undertaken in relation to the Services.
You are responsible for providing accurate, up-to-date, truthful, current, and complete information on the registration forms, including a primary email address that differs from the domain under which you are registering. In the event of any abuse issues or if we need to contact you, we will utilize the primary email address on file. It is your responsibility to ensure that the contact information associated with your account, including any domain accounts, is accurate and complete at all times. Pastis Enterprises disclaims responsibility for any interruption of Services, including, but not limited to, any lapses in domain registrations resulting from outdated contact information. If you need to verify or update your contact details, please reach out to our sales team via email or modify your information through the Pastis Enterprises Billing and Support System. Providing inaccurate contact information may result in the termination of your account.
You agree to assume full responsibility for all usage of your account and for any activities conducted through your account. It is your duty to maintain the confidentiality of your password and other security-related information for your account. Any orders for dedicated IPs that are in addition to those included in a hosting package may require justification. Please note that IP justification practices may be modified to ensure compliance with the policies set forth by the American Registry for Internet Numbers (ARIN). We reserve the right to deny any requests for dedicated IPs if sufficient justification or currently utilized IP resources are not met.
Pastis Enterprises Content
Except for User Content (defined below), all content available through our Services, including designs, text, graphics, images, videos, software, and audio files (collectively “Pastis Enterprises Content”), belongs to Pastis Enterprises or its licensors. You cannot change, copy, share, frame, reproduce, download, display, or use Pastis Enterprises Content without our permission. You also cannot try to uncover the source code or trade secrets of any Pastis Enterprises Content. Any unauthorized use will end your right to access the Services and Pastis Enterprises Content. All other rights to use Pastis Enterprises Content are reserved for Pastis Enterprises and its licensors.
User Content
You can upload, store, and share information, text, photos, videos, and other content through our Services (referred to as “User Content”). This includes content posted by you or users of your websites hosted by our Services. You are fully responsible for all User Content and any activities on your websites. By sharing User Content, you confirm that you own the rights to it and that it doesn’t violate any third-party rights.
Please note, you cannot use your /home/ directory for backups, including those from cPanel/WHM or third-party apps. All websites are backed up nightly in external locations. If you want to handle your own backups, you need to purchase additional storage from us for $29.95/month per 150GB. We reserve the right to remove any violating files and may suspend or terminate your account if you breach this policy.
For the purpose of providing our Services, you give Pastis Enterprises a non-exclusive, royalty-free license to use and distribute your User Content. You retain ownership of your content. Pastis Enterprises does not control or monitor User Content but may take corrective action, such as removing content or suspending services, at its discretion if you violate these terms. You agree that Pastis Enterprises is not liable for any such actions.
Americans with Disabilities Act (ADA)
Pastis Enterprises provides consulting services and recommendations regarding ADA compliance to assist clients in understanding their obligations under the Americans with Disabilities Act (ADA). However, Pastis Enterprises does not guarantee that the content, services, or recommendations provided will ensure full compliance with the ADA or any other legal requirement.
The responsibility for ADA compliance and adherence to all applicable laws and regulations lies solely with the client. Pastis Enterprises is not liable for any legal actions, damages, penalties, or losses arising from non-compliance or any content created, shared, or published by the client. Clients are advised to seek legal counsel for specific guidance and compliance verification.
Third Party Products and Services
Pastis Enterprises may offer third-party products and services, which are subject to the terms and conditions of the respective providers. Discounts and promotions may have additional restrictions. Confirm the terms with the third-party provider before making a purchase.
Pastis Enterprises does not guarantee the quality, availability, or timeliness of third-party goods or services and is not liable for any issues. All transactions with third-party providers are at your own risk, and we do not ensure the accuracy of their information. Pastis Enterprises is not an agent or representative in any transaction.
Pastis Enterprises as Reseller or Licensor
Pastis Enterprises may sell or license products and services from other companies (referred to as “Non-Pastis Enterprises Products”). Pastis Enterprises is not responsible for changes in its services that make these Non-Pastis Enterprises Products outdated, require changes, or affect their performance. If any Non-Pastis Enterprises Products that Pastis Enterprises sells, licenses, or provides to you have defects or malfunctions, this does not count as a failure on Pastis Enterprises’s part under this Agreement. Your rights regarding any Non-Pastis Enterprises Product are limited to what the product’s manufacturer offers you. You can only use these Non-Pastis Enterprises Products in connection with the services allowed by this Agreement. You cannot copy, alter, reverse-engineer, or tamper with these products or use them for anything other than the permitted services. You also cannot resell, transfer, export, or re-export any Non-Pastis Enterprises Products or related technical data in violation of any laws or regulations.
Artificial Intelligence Acknowledgment
Pastis Enterprises would like to acknowledge the use of Grammarly Gen AI in enhancing the clarity and quality of this document. This tool has been instrumental in providing real-time suggestions for grammar, style, and tone, allowing the company to communicate more effectively. By leveraging advanced AI technology, Grammarly helps Pastis Enterprises refine its text and ensure that it meets high standards of readability and professionalism.
Pastis Enterprises also acknowledges the use of other Artificial Intelligence providers including ChatGPT, Perplexity, and Microsoft CoPilot throughout the websites.
Pastis Enterprises also uses AI Microsoft Designer to create images to illustrate tutorials and blog posts.
Third Party Websites
The Services may link to other websites not owned or controlled by Pastis Enterprises, called “Third Party Sites.” They may also include articles, photos, text, graphics, videos, and other content from third parties, referred to as “Third Party Content.” We are not responsible for any Third Party Sites or Third Party Content you access through the Services. We do not check or monitor these sites or content for accuracy, appropriateness, or completeness. If you choose to visit Third Party Sites or use Third Party Content, you do so at your own risk. Remember that our terms and policies do not apply once you leave our Services. Please review the terms and policies of the third party, including their privacy practices, for any website you visit.
Prohibited Persons (Countries, Entities, And Individuals)
The U.S. Department of the Treasury, through the Office of Foreign Assets Control (OFAC), prohibits U.S. companies from doing business with certain countries and specific individuals or organizations that are under sanctions. These sanctioned countries and individuals are listed by OFAC as “Specially Designated Nationals” (SDN). If you are in a sanctioned country or on the SDN list, you cannot register for, subscribe to, or use our Services. Additionally, without special permission, Pastis Enterprises does not register or allow the use of any of our Services with domain names that belong to sanctioned countries.
Account Security and Pastis Enterprises Systems
You are responsible for keeping any scripts or programs installed under your account secure. Make sure the permissions for your directories are set correctly, ideally to 755 or as restrictive as possible. Remember, you are responsible for all actions taken using your account. This includes any compromise of your username and password. Always use a secure password. If you use a weak password, your account may be suspended until you switch to a stronger one. We may conduct audits to check for weak passwords. If your password does not meet our standards, we will notify you and give you time to change it before suspending your account.
The Services, including all related equipment and networks, are meant only for authorized customer use. Pastis Enterprises may monitor our systems to ensure authorized use, protect against unauthorized access, and verify security procedures. During this monitoring, we may examine, record, copy, and use information for authorized purposes. By using our Services, you agree to this monitoring.
If your account connects to a third-party network or system without that party’s permission, it may be suspended. You need written consent from the third party to access their networks or systems. Pastis Enterprises may ask for documentation to confirm that your access is authorized. If your account is found to be compromised, we may disable or terminate it. If you don’t resolve an issue after we notify you, we can keep your account disabled. If you want us to clean up your account, you may request this for an additional fee.
Pastis Enterprises can move your account from one data center to another to follow data center policies, local laws, or for other technical reasons without prior notice..
HIPAA Disclaimer. We are not “HIPAA compliant.”
You are responsible for ensuring that you comply with all applicable federal and state laws concerning the privacy and security of personal data, including sensitive information like medical data. Please note that our Services may not be suitable for storing or managing sensitive data, including information related to children or health matters. Pastis Enterprises does not monitor or control the information you store or transmit using our Services.
We explicitly state that our Services do not guarantee compliance with the federal Health Insurance Portability and Accountability Act (HIPAA). If you need to securely store “protected health information” as defined by HIPAA, you are not permitted to use our Services for this purpose. Violating this policy by storing or granting access to protected health information will result in immediate termination of your account.
Furthermore, we do not enter into “Business Associate Agreements,” and you acknowledge that Pastis Enterprises does not act as a Business Associate, subcontractor, or agent of yours under HIPAA regulations. If you have any questions regarding the security of your data, please contact support@pastisenterprises.com.
Compatibility with the Services
You agree to fully cooperate with Pastis Enterprises while they provide the Services. You are responsible for supplying any equipment or software you need to use the Services. If any delays occur because you do not fulfill your responsibilities on time, Pastis Enterprises will not be liable.
You must ensure that all User Content and User Websites work with the hardware and software that Pastis Enterprises uses to provide the Services. Pastis Enterprises may change this hardware and software at any time.
You are also responsible for backing up all User Content, including any User Websites. Pastis Enterprises does not guarantee that it will back up any User Content, so you accept the risk of losing any or all of it.
Billing and Payment Information
Multiple Accounts
You agree to work closely with Pastis Enterprises while they provide the Services. It’s your responsibility to have any necessary equipment or software to use these Services. If there are delays because you don’t meet your responsibilities on time, Pastis Enterprises is not responsible for those delays.
You need to make sure that all User Content and User Websites are compatible with the hardware and software Pastis Enterprises uses to provide the Services. This hardware and software might change at any time.
You are also responsible for backing up all User Content, including User Websites. Pastis Enterprises does not promise to back up User Content, so you accept the risk of losing any or all of it.
Prepayment
You agree to work with Pastis Enterprises while they provide the Services. You must have the necessary equipment or software to use the Services. If there are delays because you don’t complete your tasks on time, Pastis Enterprises isn’t responsible.
You need to ensure that all User Content and User Websites work with the hardware and software used by Pastis Enterprises, which may change anytime.
You are responsible for backing up all User Content and User Websites. Pastis Enterprises does not guarantee any backups, so you accept the risk of losing your content.
Autorenewal
Unless you notify Pastis Enterprises to cancel the Services, you will be automatically billed to avoid service disruption using your stored payment information.
Taxes
Listed fees for the Services do not include any applicable sales, use, revenue, excise or other taxes imposed by any taxing authority. Any applicable taxes will be added to Pastis Enterprises’s invoice as a separate charge to be paid by you. All fees are non-refundable when paid unless otherwise stated.
Late Payment
Invoices must be paid within four days of the due date. Failure to do so may result in the suspension or termination of services, and access to the account will be restricted until payment is received. Pastis Enterprises may also pursue collection costs, including legal fees. Additionally, new orders or packages will not be activated for customers with outstanding balances.
Domain Payments
It is solely your responsibility to notify Pastis Enterprises’ Billing department via a support ticket created from https://pastisenterprises.net/billing/index.php?rp=/login after purchasing a domain. Domain renewal notices are provided as a courtesy reminder and Pastis Enterprises is not responsible for a failure to renew a domain or a failure to notify a customer about a domain’s renewal. Domain renewals are billed and renewed thirty (30) days before the renew date.
Fraud
You are prohibited from misusing or fraudulently using credit cards, charge cards, electronic funds transfers, electronic checks, or any other form of payment as outlined in this Agreement. Pastis Enterprises reserves the right to report any instances of misuse or fraud—at their sole discretion—to government authorities, law enforcement, credit reporting agencies, financial institutions, and/or credit card companies.
Invoice Disputes
You have ninety (90) days to dispute any charge or payment processed by Pastis Enterprises. If you have any questions concerning a charge on your account, our billing department directly for assistance.
Money-back Guarantee
Pastis Enterprises provides a thirty (30) day money-back guarantee specifically for its hosting services. If you find that you are not fully satisfied with these services and choose to terminate your account within thirty (30) days of signing up, you are eligible for a refund of the hosting fees paid, excluding any setup fees. Please note that this guarantee is limited to hosting service fees and does not cover administrative fees, installation fees for custom software, or any other additional service fees.
Cancellations and Refunds
Payment Method
If you make a payment using specific methods, you won’t be able to receive a cash refund if you decide to cancel or request one later. Instead, any credit you might have will be added to your hosting account for future use. The payment methods that fall under this policy include bank wire transfers, peer-to-peer payment apps, Western Union payments, checks, and money orders. So, it’s important to choose a different payment method if you think you might want the option for a refund later on.
Refund Eligibility
You can only get a refund if this is your first account with us. If you’ve had an account before, canceled it, and signed up again, or if you opened a second account, you won’t qualify for a refund. If you break any rules in this Agreement, you will also lose your right to a refund.
Non-refundable Products and Services.
Refunds are not available for domain names, dedicated servers, administrative fees, license fees, or custom software installation. Domain refunds may only be considered if ordered with a hosting package and are at Pastis Enterprises’s discretion. Any domain refunds will be reduced by the market value of the gTLD. Purchases of ccTLDs are non-refundable.
Cancellation Process
You can cancel the Services by sending Pastis Enterprises a written notice using the cancellation form provided in the client area. If you cancel: (i) you must pay all fees that accumulated before the cancellation takes effect, and (ii) there will be no refund for any remaining service period unless the product/service has been active for less than 30 days, as part of our 30-day money-back guarantee.
After we receive your cancellation form and confirm your information via email, we will let you know in writing (usually by email) that your account is canceled. This confirmation will include a ticket/tracking number in the subject line for your reference. You should get an automatic email right away stating that “Your request has been received.” We will then confirm your request and process your cancellation shortly.
If you don’t hear from us or don’t get the automatic confirmation email within a few minutes of submitting your cancellation form, please contact us right away. All cancellations must be submitted through the online form to (a) verify your identity, (b) confirm that you are aware your files and emails will be removed, and (c) document your request. This process helps prevent mistakes and ensures you know that your files, emails, and account may be removed immediately and permanently once your cancellation request is processed.
Cancellations for shared accounts will be effective on the account’s renewal date.
Domains
Domain renewals are billed and renewed thirty (30) days before the renewal date. It is your responsibility to notify Pastis Enterprises’ Billing department via a support ticket created from https://pastisenterprises.com/billing/submitticket.php?step=2&deptid=1 to cancel any domain registration at least thirty (30) days prior to the renewal date. No refunds will be given once a domain is renewed. All domain registrations and renewals are final.
Termination
Pastis Enterprises may terminate your access to the Services without notice if you: (i) fail to pay fees; (ii) violate this Agreement; (iii) engage in harmful conduct; or (iv) as specified otherwise in this Agreement. No fees paid in advance will be refunded, and you must pay all outstanding charges. Additionally, you may be charged for remaining fees for the current term. Upon termination, all User Content, User Websites, and other data will be deleted.
CPU, Bandwidth and Disk Usage
Permitted CPU and Disk Usage.
All use of hosting space provided by Pastis Enterprises must follow this Agreement and the Acceptable Use Policy. You can only use shared hosting space for web files, active email, and content for your websites. You cannot use shared hosting space for storage, including media, emails, or other data, and it cannot be used for offsite storage of electronic files, email, or FTP hosts.
Pastis Enterprises has the right to review each shared account for excessive use of CPU, disk space, or other resources that may violate this Agreement or the Acceptable Use Policy. We may terminate access to the Services, charge extra fees, or remove your content if we find that your account violates our terms and conditions.
VPS Managed Services
Please note that manually installing modules and bypassing WHM/cPanel could render your management with us void.
Bandwidth Usage
Shared servers are not limited in their bandwidth allowance.
Uptime Guarantee
If your shared server has unscheduled downtime that is less than the 99.9% uptime guarantee, you may receive account credits at our discretion. This guarantee does not cover planned maintenance. Any approval for credits is solely up to Pastis Enterprises and may depend on your explanation. Reports from third-party monitoring services cannot be used for justification because of various factors, including the monitor’s network capacity and availability. We define server uptime as the time reported by the operating system and the Apache Web Server, which may differ from what individual services report. To request a credit, please visit https://pastisenterprises.net/billing/clientarea.php and create a support ticket for our Billing department with your explanation. Uptime guarantees apply only to shared and reseller solutions.
Price Change
Pastis Enterprises may change prices, monthly payments, or other charges at any time with at least thirty (30) days’ notice. It is your responsibility to regularly review billing information provided by Pastis Enterprises.
Coupons
Discounts and coupon codes are reserved for first-time accounts or first-time customers only and may not be used towards the purchase of a domain registration unless otherwise specified. If you have previously signed up using a particular domain, you may not sign up again for that domain using another coupon at a later date. Any account found in violation of these policies will be reviewed by our Sales department and the appropriate charges will be added to the account. Coupon abuse will not be tolerated and may result in the suspension or termination of your account. All coupons and discounts are only valid towards the initial purchase and do not affect the renewal or recurring price.
Limitation of Liability
PASTIS ENTERPRISES, ALONG WITH ITS DIRECTORS, EMPLOYEES, AND AGENTS, WILL NOT BE RESPONSIBLE FOR ANY INDIRECT OR SPECIAL DAMAGES. THIS INCLUDES ANY LOST PROFITS OR LOST DATA RESULTING FROM YOUR USE OF OUR SERVICES, USER CONTENT, USER WEBSITES, OR OTHER MATERIALS ACCESSED OR DOWNLOADED THROUGH OUR SERVICES, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES MIGHT HAPPEN.
REGARDLESS OF ANYTHING ELSE STATED HERE, IF YOU OR ANYONE CLAIMING THROUGH YOU MAKES A CLAIM AGAINST PASTIS ENTERPRISES, OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICES IN THE THREE MONTHS BEFORE THE INCIDENT THAT CAUSED THIS LIABILITY. THIS IS THE TOTAL LIMIT, AND HAVING MORE THAN ONE CLAIM WILL NOT INCREASE THIS LIMIT.
Indemnification
You agree to protect and defend Pastis Enterprises, our affiliates, and their officers, directors, employees, and agents (together called the “Indemnified Parties”) from any claims, damages, losses, or legal actions brought by a third party. This includes any expenses, such as reasonable attorney’s fees, related to (i) your use of the Services, (ii) your violation of this Agreement, or (iii) any actions or failures to act by you. This agreement to protect the Indemnified Parties remains in effect even after this Agreement ends.
Arbitration
When you use our services, you agree to resolve any disputes related to this agreement through arbitration with the American Arbitration Association (AAA). The arbitration will be led by one arbitrator chosen by Pastis Enterprises, and it will take place at an AAA location chosen by Pastis Enterprises in Missouri.
The costs for filing, administration, and arbitrator fees will follow the AAA’s rules, unless stated otherwise. If you can show that the cost of arbitration is too high compared to going to court, Pastis Enterprises will cover some of your fees as the arbitrator sees fit to make arbitration affordable.
The arbitration will only address individual claims. You cannot bring claims on behalf of others or as part of a class action. The Federal Arbitration Act governs this arbitration, not any state laws. The arbitrator’s decisions will be final and binding for all parties involved.
The arbitrator can only make decisions on claims between you and Pastis Enterprises. You cannot combine your claims with others unless everyone involved agrees in writing. An arbitration decision will not affect any claims outside of this arbitration that involve individuals not named in the dispute.
If you try to take legal action against Pastis Enterprises instead of following this arbitration process, you agree to pay for Pastis Enterprises’ reasonable legal costs related to enforcing this agreement.
Independent Contractor
Pastis Enterprises and the User operate as independent contractors. This Agreement does not establish a principal-agent relationship, partnership, or joint venture between them. Neither party has, nor may imply, any authority to enter into contracts or agreements on behalf of the other party, nor can they obligate or bind each other in any way.
Governing Law; Jurisdiction
Any dispute related to your access or use of our Services or this Agreement shall be submitted to confidential arbitration in Visalia, CA, conducted according to the American Arbitration Association’s Consumer Rules. The arbitration will be in English with one arbitrator, and their decision will be final and binding. Each party is responsible for their own arbitration fees. No arbitration may be combined with another involving other parties, and appearances may be made electronically or telephonically. Claims must be filed within one year, and either party may seek equitable relief in a court of competent jurisdiction. If arbitration is not permitted by law, disputes shall be resolved solely in a court located in Visalia, CA.
Opt-Out
You can opt out of the dispute resolution provision by notifying Pastis Enterprises within 30 days of entering this Agreement or purchasing a subscription. Send a written request to Pastis Enterprises, PO Box 829, Visalia, CA 93279, USA, attn: Arbitration Opt-Out, including your name, address, account information, and a clear statement that you do not wish to arbitrate disputes. If you opt out, disputes will be resolved in court in Visalia, CA.
Class Action Waiver
You and Pastis Enterprises agree that any disputes will be resolved individually, waiving jury trials. You will not pursue any class action or similar actions.
Disclaimer
Pastis Enterprises is not liable for any damages your business may incur. We make no warranties, express or implied, regarding our Services, including merchantability or fitness for a particular purpose. This includes losses from delays, delivery failures, and service interruptions caused by us or our employees.
Backups and Data Loss
You use our services at your own risk. Pastis Enterprises runs a backup service once a night, but it only keeps one day’s worth of backups, overwriting any previous ones. This backup service is a courtesy for shared and reseller accounts only and may change or stop at any time at our discretion. We do not back up VPS accounts, accounts larger than 20GB, or accounts with over 100,000 inodes. Pastis Enterprises is not responsible for any files or data in your account. You are fully responsible for your files and data, and you need to keep your own backups of everything stored on our servers.
Limited Warranty
THE SERVICES OFFERED UNDER THIS AGREEMENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. EXCEPT AS CLEARLY STATED IN THIS SECTION, PASTIS ENTERPRISES AND OUR AFFILIATES, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS DISCLAIM ALL KINDS OF WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A SPECIFIC PURPOSE, OR NON-INFRINGEMENT, FOR THE SERVICES PROVIDED HEREUNDER. PASTIS ENTERPRISES AND OUR AFFILIATES, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS MAKE NO REPRESENTATIONS OR WARRANTIES (I) THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE; (II) REGARDING THE RESULTS THAT MAY BE OBTAINED FROM USING THE SERVICES; OR (III) CONCERNING THE ACCURACY, RELIABILITY, OR CONTENT OF ANY INFORMATION PROVIDED THROUGH THE SERVICES. PASTIS ENTERPRISES AND OUR AFFILIATES, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS ARE NOT LIABLE AND EXPRESSLY DISCLAIM ANY LIABILITY FOR THE CONTENT OF ANY DATA TRANSFERRED TO OR FROM USERS OR STORED BY USERS ON OR THROUGH THE SERVICES. THE TERMS OF THIS SECTION SHALL REMAIN IN EFFECT EVEN AFTER THE TERMINATION OF THIS AGREEMENT.
Disclosure to Law Enforcement
Pastis Enterprises may share any information we collect about you with law enforcement if they request it for an investigation. We will do this without notifying you or getting your consent first. Entire Agreement
This Agreement supersedes all prior discussions and agreements between the parties and constitutes the sole agreement regarding the matters covered herein.
Headings
The headings herein are for convenience only and are not part of this Agreement.
Changes to the Agreement or the Services
Pastis Enterprises can change this Agreement at any time. If we make significant changes, we will post a notice on the Pastis Enterprises website for at least thirty (30) days. We will also show the date of the last revision at the bottom of this Agreement. Any changes will take effect once they are posted unless stated otherwise. By continuing to use the Services after the changes are made, you agree to the new terms.
Pastis Enterprises also reserves the right to change, modify, or stop any part of the Services at any time.
Severability
If any part of this Agreement is determined by a court of competent jurisdiction to be illegal, invalid, or unenforceable, the other provisions shall continue to be fully effective, unless stated otherwise.
Waiver
You or Pastis Enterprises can take your time to use any rights or remedies in this Agreement without losing the chance to do so later. Just because you use a right or remedy partially, or only once, doesn’t mean you can’t use it again fully or in a different way. If any party agrees to overlook a breach of this Agreement, it does not mean they agree to overlook future breaches of the same or other terms.
Assignment; Successors
Users cannot transfer their rights or obligations under this Agreement without prior written consent from Pastis Enterprises; any unauthorized transfer is invalid. In contrast, Pastis Enterprises can assign their rights and obligations or use subcontractors without user consent. This Agreement is binding on both parties and their respective successors and permitted assigns.
Force Majeure
Neither party is responsible for any failure or delay in meeting their obligations under this Agreement, except for missed payments, if the failure or delay is due to events that are beyond their control. These events include, but are not limited to, fire, flood, natural disasters, labor disputes, accidents, war, terrorism, transportation or communication interruptions, supply shortages, or the inability of a third party to fulfill their commitment related to the production or delivery of any needed equipment or materials.

Electronic Notices
When you communicate with Pastis Enterprises—whether through the Platform, emails, or mobile notifications—you agree to receive messages from them electronically. This means that all terms, agreements, notices, and other important information they send you electronically will be considered as valid as if they were in writing. Your legal rights remain unchanged.
Third-Party Beneficiaries
Unless this Agreement says otherwise, it is not meant to give any rights to anyone except the parties involved and their approved successors or assigns. However, if a third-party product or service is mentioned in the service description as having a third-party beneficiary, that supplier is an intended beneficiary. They have the right to directly enforce the terms of this Agreement with the user regarding their products or services as if they were a party to this Agreement.
