By using the services offered by Pastis Enterprises, you agree to adhere to this Acceptable Use Policy (AUP). This policy is legally binding and is part of our Terms of Service.
This Acceptable Use Policy (“AUP”) regulates your utilization of the Services and is included by reference in Pastis Enterprises’ Terms of Service. Unless stated otherwise, the defined terms in this AUP carry the meanings provided in the Terms of Service. Pastis Enterprises retains the right to amend this AUP at any time without prior notice.
The Services provided by Pastis Enterprises are intended for lawful use only. You must comply with all relevant laws, regulations, and rules while utilizing the Services. Pastis Enterprises has the authority to deny service to anyone. Any content that, in our discretion, breaches this AUP may be removed from our servers or disabled, with or without prior notice. If you fail to respond to an email from our abuse department within the specified timeframe, it may lead to suspension or termination of the Services.
You are accountable for the actions of your agents, representatives, and end-users (“Users”), ensuring they follow this AUP. The Services are to be used exclusively for valid business and commercial reasons. You must not engage in activities that, at Pastis Enterprises’s sole discretion, could be deemed illegal, offensive, abusive, or that might disrupt or negatively impact the Services or their use (including intentional attempts to overload a system or launch broadcast attacks), or that could subject Pastis Enterprises to criminal or civil liability.

Prohibited Uses
Violation of Intellectual Property Rights
It is strictly forbidden to use the Services in a manner that infringes on the intellectual property rights of others. This encompasses, but is not limited to, the unauthorized duplication or distribution of films, music, literary works, images, software, or any other copyrighted materials. Engaging in the sale or offering counterfeit goods will lead to immediate account termination. Accounts identified as infringing upon others’ intellectual property rights will be promptly removed, or access to the infringing content will be blocked. Repeated violations of this policy may result in account suspension or termination.
If you suspect that your intellectual property rights are being violated, please reach out via email at support@pastisenterprises.com. For claims related to copyright infringement, Pastis Enterprises adheres to the procedures outlined in the Digital Millennium Copyright Act (“DMCA”) for notice and takedown.
Using a Shared Account for Backup or Storage
Shared hosting accounts are not permitted to be used as a backup or storage solution, with the exception of a single cPanel backup of that account. Please refrain from creating backups of existing backups.
Unacceptable Material
Zero Tolerance Adult Content Policy
Pastis Enterprises has a zero tolerance policy in effect for adult content. We do not allow any content considered “adult material” on our servers. This includes any type of media that may contain nudity, partial nudity, or anything else of adult nature determined in Pastis Enterprises’s sole discretion. Violators of this policy will be immediately terminated without a refund. Additional prohibited content is outlined below:
Unacceptable material on our servers include without limitation:
- Anonymous or Bulk SMS Gateways
- Any website related to Cannabis, CBD is strictly forbidden.
- AutoSurf/PTC/PTS/PPC sites
- Bank Debentures/Bank Debenture Trading Programs
- Banner-Ad services (commercial banner ad rotation)
- Bitcoin Miners
- Broadcast or Streaming of Live Sporting Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF, etc)
- Bruteforce Programs/Scripts/Applications
- Commercial Audio Streaming (more than one or two streams)
- Engaging in offensive activities such as harassment or transmitting or distributing content that is inappropriate, obscene, defamatory, threatening, abusive, that advocates violence, or that violates a law, regulation, or public policy.
- Escrow/Bank Debentures
- File Dump/Mirror Scripts (similar to rapidshare)
- Forums and/or websites that distribute or link to warez/pirated/illegal content
- Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)
- Hacker focused sites/archives/programs
- Hacking, phishing, spamming, scamming, identity theft, fraud, forgery, deception, virus or malware distribution, network attacks, and interference with any other user’s use of the Services.
- High-Yield Interest Programs (HYIP) or Related Sites
- Image Hosting Scripts (similar to Photobucket or Tinypic)
- In addition, you and your Users must comply with all applicable laws, rules and regulations related to your use of the Services, specifically including data protection and privacy laws, as well as laws relating to unsolicited commercial electronic messages.
- Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
- IP Scanners
- IRC Scripts/Bots
- IRCD (irc servers)
- Lottery/Gambling Sites

- Sale of any controlled substance without prior proof of appropriate permit(s)
- Sites promoting illegal activities
- Tell A Friend Scripts
- The unauthorized access, monitoring, collection, or use of data, systems or networks.
- Topsites
- Transmitting, distributing or storing illegal or fraudulent information or material or information or material that will infringe or otherwise violate any privacy, intellectual property, publicity or other personal rights including, any copyright, patent, trademark, trade secret or other proprietary right
Child Pornography Prohibited
Any content that could be harmful to minors is strictly prohibited, as determined solely by Pastis Enterprises. This includes, but is not limited to, child pornography or any content that may be interpreted as such. Websites discovered to host or link to child pornography will be suspended immediately, without prior notification.
Free Web Hosting Not Allowed
Hosting Clients are not allowed to provide “free web hosting” services to their customers.
Other Prohibited Content
We retain the right to deny service to any individual. Any content that we deem to be offensive, threatening, unlawful, or that breaches our Terms of Service or this Acceptable Use Policy in any way may be deleted from our servers (or otherwise deactivated), with or without prior warning.
Unacceptable Resource Usage
You may not:
· Use 25% or more of our system resources for longer than 90 seconds. Activities that may lead to this excessive usage include, but are not limited to, CGI scripts, FTP, PHP, and HTTP.
· Do not run independent, unattended server-side processes at any time on the server. This includes all types of daemons, such as IRCD.
· Do not operate any kind of web spider or indexer (including tools like Google Cash or AdSpy) on shared servers.
· Refrain from running any software that connects to an Internet Relay Chat (IRC) network.
· Do not use any BitTorrent applications, trackers, or clients. While you can link to legal torrents off-site, you are not permitted to host or store them on our shared servers.
· Avoid participating in any file-sharing or peer-to-peer activities.
· Do not operate gaming servers such as Counter-Strike, Half-Life, Battlefield 1942, etc.
· Avoid setting cron jobs with intervals shorter than 15 minutes.
· Do not execute any MySQL queries that last longer than 15 seconds. Ensure that MySQL tables are appropriately indexed.
· When using PHP, include local files instead of URLs. For example, use “include.php” rather than “http://yourdomain.com/include.php”).
· Use HTML to handle server-side code (like PHP and SHTML) in order to minimize resource usage.
INODES.
Using more than 250,000 inodes (which are just a way to count files on your account) on any shared or reseller hosting account can lead to a warning. If you don’t reduce the number of inodes after receiving a warning, your account may be suspended. If you exceed 100,000 inodes, your account will be automatically removed from our backup system to prevent overuse, but we may still back up your databases as a courtesy.
Every file type—like web pages, image files, and emails—counts as one inode.
Accounts that frequently create and delete many files, have hundreds of thousands of files, or cause damage to the file system may be reviewed and possibly suspended. One common reason for having too many inodes is when users keep their catchall email address (which collects all emails sent to your domain) turned on and don’t regularly check their main mailbox. Over time, this can lead to thousands of unviewed messages and push you over the inode limit.
To prevent this, you can turn off your catchall email feature by logging into cPanel, clicking on “Mail,” then “Default Address,” selecting “Set Default Address,” and entering “:fail: No such user here” to stop receiving extra emails.
Zero Tolerance Spam Policy
We do not allow unsolicited emails, bulk emails, or spam. This includes “safe lists,” purchased lists, and selling lists, which we also consider spam. We may cancel the account of any user who sends spam without notice.
Websites that use spam for advertising (known as Spamvertised) cannot be hosted on our servers. This rule applies to spam sent by fax, phone, postal mail, email, instant messaging, or usenet/newsgroups. No organization listed in the ROKSO can be hosted on our servers. If any user account causes our IP space to be blacklisted, we will immediately suspend or terminate it.
Pastis Enterprises can require changes or disable any website, account, database, or component that does not follow our policies. We may also make urgent changes as needed at our discretion.
Pastis Enterprises can charge the account holder who sends unsolicited emails a cleanup fee or any costs to remove blacklisting, at our discretion.

Defamation Policy
Websites hosted on Pastis Enterprises’s servers in the U.S. follow U.S. law. According to Section 230(c) of the Communications Decency Act, our policy is to not remove content that is claimed to be defamatory unless a court has officially found it to be so. As a web host, Pastis Enterprises does not publish user content and cannot investigate individual defamation claims. We depend on the legal system and courts to decide if content is truly defamatory. If a court order confirms that material is defamatory, libelous, or slanderous, we will disable access to it. Likewise, if a U.S. court orders us to remove specific content, we will comply and take the necessary steps to remove or disable access to that content.
Pastis Enterprises’ Rights
Pastis Enterprises has the right to investigate any actual or suspected violations of this Acceptable Use Policy (AUP) at any time. You must cooperate reasonably with Pastis Enterprises when they investigate and fix any actual or alleged breaches of this AUP by you or any user. Pastis Enterprises may also work with legal authorities and others to investigate these violations, which includes sharing the identity of any user they believe is responsible. They may use technical methods to prevent violations of the AUP.
This AUP does not limit Pastis Enterprises’ legal rights and options that may be available.
Disclaimer
Pastis Enterprises is not required to monitor user activities and is not responsible for any misuse of the Services by users. We do not take responsibility for any user or third-party material or information created, stored, maintained, transmitted, or accessible through the Services. We are also not obligated to check or control this material. If we become aware of any material that violates this Acceptable Use Policy (AUP) or could expose us to legal issues, we may choose to block access to it, but we are not required to do so. Unless stated otherwise in this AUP, we have no obligations to anyone who has not entered into an agreement with Pastis Enterprises for using the Services.
AUP Violations
Your Services may be terminated with or without notice upon any violation of this AUP. If applicable, violations will be reported to the appropriate law enforcement agency.
